Background Information:
The U.S. Department of Commerce announced the preliminary results of its investigation on the implementation of an anti-subsidy regulation on imports of Chinese construction paper on March 30th of 2007. After the investigation, Congress finally decided to apply the anti-subsidy regulation to China and has begun to impose a temporary anti-subsidy tariff on Chinese exported construction paper to America. The Chinese government has expressed strong disapproval of the decision and the incident could lead to an elevation in the already tense trade relationship between China and the U.S.
The causes behind this recent development: On October 31st of 2006, the paper manufacturer NewPage from Ohio lodged a complaint with the U.S. Department of Commerce, in which it declared that the Chinese government supported many Chinese paper manufacturers with subsidy policies including preferential duties, debt leniency and soft loans. NewPage demanded that the U.S. Congress charge these companies an anti-subsidy tariff. Also, NewPage accused these companies of operating product dumping procedures.
The response from America: In response to the accusations of NewPage, the U.S. Department of Commerce commenced an investigation on the subsidy policies of the Chinese government. It published the preliminary results of the investigation on March 30th of 2007. Finally, Congress decided to apply an Anti-subsidy Law to China and began to impose a temporary anti-subsidy tariff on Chinese-exported construction paper.
The response from China: In response to the U.S. investigation on China's governmental subsidy policies, the Chinese government reacted swiftly and entrusted a lawyer team from Vinson & Elkins, which is a prestigious firm in the field of international commerce, as its representatives in the issue. In the early morning of March 31st, in reaction to the U.S. discussion to impose an anti-subsidy tariff, the Chinese government expressed strong disapproval.
